Zopec Medical Limited Warranty Statement

At Zopec Medical, we are committed to providing high-quality products and reliable support to our customers. This Limited Warranty applies exclusively to batteries and devices sold directly to patients through authorized dealers. The warranty is valid only for the original end user or patient and is non-transferable.

The warranty period begins on the date of purchase from an authorized store. Zopec Medical warrants that our products will be free from defects in material and workmanship and will perform in accordance with the stated product specifications for the duration of the warranty.

If a product covered under warranty is found to be defective due to normal use, Zopec Medical will, at its sole discretion, repair or replace the defective part, component, or the entire product.


Warranty Exclusions

This Limited Warranty does not cover the following:

  • Improper use, abuse, neglect, mishandling, or unauthorized modification of the product

  • Exposure to ozone or ozone-generating devices intended for product sanitation

  • Service or repairs performed by non-authorized service providers

  • Smoke damage (including damage from cigarette, cigar, or pipe smoke)

  • Damage or contamination from water, liquid spills, pests, insects, or rodents

  • Cosmetic wear and tear that does not affect product functionality

This warranty replaces all other expressed or implied warranties, including those of merchantability or fitness for a particular purpose. Zopec Medical is not liable for incidental or consequential damages resulting from the use, sale, installation, or performance of its products. Some jurisdictions may not allow such exclusions; consult local laws for applicability.

Non-Covered Warranty Claims: Evaluation Policy and Customer Liability

1. Scope and Applicability

This section outlines the terms and conditions governing situations where a Zopec Medical product is submitted for warranty evaluation and is subsequently found not to qualify for warranty coverage. Causes of exclusion may include, but are not limited to:

  • Water or liquid damage

  • Physical damage due to dropping or impact

  • Evidence of misuse, neglect, or tampering

  • Exposure to unauthorized cleaning methods (e.g., ozone)

  • Damage from pests, smoke, or environmental contamination

All determinations regarding warranty eligibility are made solely at the discretion of Zopec Medical’s Technical Evaluation Team and are considered final.

Shipping Policy: When replacements or loaner units are issued, Zopec Medical will cover standard ground shipping for customers located in the contiguous United States, Canada, and Australia. Customers outside of these regions may be responsible for shipping costs. All applicable shipping charges will be communicated to the customer in advance, either verbally or in writing, prior to shipment.

Shipping charges must be prepaid before the shipment is released, unless the customer chooses to have the charges billed via invoice. Invoiced shipping charges will carry NET 30 payment terms, and Zopec Medical reserves the right to apply interest to any overdue shipping invoices, in accordance with its standard billing policies.


2. Replacement Prior to Evaluation

If a replacement product is issued to the customer prior to the completion of the warranty evaluation, and the original product is subsequently determined to be not covered under warranty, the following shall apply:

  • Formal communication of the warranty denial will be provided to the customer, either via phone call or written email.

  • All warranty denial notifications will include supporting evidence and justification for the determination, such as photographs, test results, or inspection findings.

  • Upon issuance of this communication, a NET 30 invoice will be generated for the full retail value of the replacement product.

  • Zopec Medical reserves the right to charge accrued interest on overdue invoices, in accordance with standard commercial practices and applicable laws.


3. Loaner Unit Prior to Evaluation

If a loaner product is issued to the customer prior to warranty evaluation, and the original product is found not to be eligible for warranty coverage, the following conditions apply:

  • The customer will receive formal communication of the warranty denial, either via phone call or written email.

  • All communications will include documented evidence supporting the denial, such as photos, diagnostics, or condition reports.

  • A return shipping label will be issued at the time of communication. If the loaner product is not returned within 30 calendar days, the customer will be invoiced for the full retail value of the loaner item.

  • The invoice will carry NET 30 payment terms.

  • Zopec Medical reserves the right to assess interest charges on any unpaid balance beyond the due date, in accordance with prevailing business practices and applicable laws.


4. Customer Acknowledgment

By submitting a product for warranty evaluation, the customer confirms they have reviewed and accepted Zopec Medical’s warranty terms. It is the customer’s responsibility to adhere to return instructions and fulfill financial obligations as outlined above.

Failure to comply with these terms may result in additional collection actions, including, but not limited to, interest accrual, late fees, and third-party recovery procedures.
